Terms of Service

These Terms govern your access to and use of Dustoff ("the Service"), provided by Invomate ("Dustoff", "we", "us"). By creating an account, you agree to be bound by them. If you don't agree, don't use the Service.
1. Who can use Dustoff
You must be at least 18 years old and authorized to enter into contracts on behalf of the business you're representing. You must provide accurate business information, including your legal business name, address, and phone number, so that messages sent through Dustoff comply with telecom regulations.
2. What Dustoff does
Dustoff is a software tool that helps a small business ("you") reach out to your own customers — people who have already given you express consent to be contacted — through SMS and email. We provide AI-drafted message suggestions, delivery via Twilio and SendGrid, and a dashboard for review and analytics.
Dustoff is not a marketing list provider. We do not give you contacts. You bring your own customer list, and you remain the "sender of record" for every message sent through Dustoff.
3. Your obligations — read this carefully
You are solely responsible for ensuring that every message you send via Dustoff complies with the law. In particular, you agree that:
- You have express, documented consent from every person on every list you upload, in compliance with Canada's Anti-Spam Legislation (CASL), CAN-SPAM (U.S.), TCPA (U.S.), and the CRTC's Unsolicited Telecommunications Rules.
- You will honor opt-out requests immediately, including any "STOP" replies (Dustoff processes these automatically, but you may not work around the suppression list).
- Your messages will identify your business clearly and contain a valid unsubscribe mechanism. Dustoff's AI is configured to enforce both, but final approval and legal responsibility rest with you.
- You will not send: messages on behalf of someone else's business, harassing/abusive content, content that solicits illegal activity, content that violates third-party intellectual property, or any commercial electronic message to a recipient outside your own customer relationship.
- You will keep records of consent for at least 3 years, as CASL requires.
If you violate this section, regulators — not Dustoff — will fine your business. CASL fines can reach CAD $10M per violation. We are a service provider; you are the sender. Dustoff reserves the right to suspend or terminate accounts that we reasonably believe are non-compliant.
4. Account security
You're responsible for keeping your login credentials safe and for every action taken under your account. Notify us immediately at security@dustoff.invomate.me if you suspect unauthorized access.
5. Subscriptions and billing
- Dustoff is sold as a monthly or annual subscription. Pricing is published at dustoff.invomate.me and may change with 30 days' notice to existing subscribers.
- All payments are processed by Stripe and are charged in advance of the billing period.
- SMS messages may be metered separately. Twilio carrier fees pass through at cost.
- You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We don't issue prorated refunds for partial periods.
- If a payment fails, we may suspend message sending until billing is current. Account data is retained for 30 days after cancellation.
6. Intellectual property
Dustoff (the platform, code, design, brand) belongs to Invomate. You get a limited, non-exclusive, non-transferable right to use it for your own business.
You retain ownership of your customer data, your business assets, and the content of messages you send. By using Dustoff you grant us a limited license to process that data only to operate the Service for you.
AI-generated drafts: you may use, edit, send, and own the messages Dustoff drafts for your campaigns. We don't claim copyright in machine-generated text.
7. Service availability
We aim for 99.5% monthly uptime and will publish maintenance windows in advance when possible. Dustoff is offered "as is" and "as available". Delivery of SMS and email depends on third-party carriers and providers we do not control.
8. Disclaimers
To the maximum extent permitted by law, Dustoff and Invomate disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated drafts will be legally compliant for your specific industry without your review.
9. Limitation of liability
To the maximum extent permitted by law, Invomate's total liability arising out of or related to these Terms or the Service will not exceed the amount you paid Dustoff in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, or lost data.
Some jurisdictions don't allow these limitations. Where that applies, the limits above apply to the maximum extent permitted.
10. Indemnification
You agree to defend, indemnify, and hold harmless Invomate, its officers, employees, and contractors from any claim, demand, regulatory fine, or expense (including reasonable legal fees) that arises out of: (a) your use of the Service in violation of these Terms; (b) any messages you authorize that violate CASL, CAN-SPAM, TCPA, CRTC rules, or any other applicable law; (c) your infringement of any third party's rights.
11. Termination
You can stop using Dustoff at any time. We can suspend or terminate your account for material breach of these Terms — particularly Section 3 — with notice when practical. On termination, your sending capability ends immediately and your account data is retained for 30 days before permanent deletion.
12. Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law principles. The courts located in Vancouver, BC have exclusive jurisdiction.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be announced by email at least 30 days before they take effect. Continued use of the Service after the effective date means you accept the new Terms.
